GENERAL TERMS AND CONDITIONS AND PRIVACY POLICY OF THE "4TH RECTORS' MEETING – UNIVERSIA 2018"

1. PURPOSE
The purpose of these General Terms and Conditions (hereinafter, “the Terms and Conditions") is to establish the rules that will govern provision of the service and the processing of any personal data that Banco Santander, S.A., with postal address for these purposes at Avda. de Cantabria s/n, Edificio Pereda, 28660 Boadilla del Monte (Madrid), with tax ID number (Spanish NIF) A-39000013 and contact e-mail address of organizacionivencuentrorectoresuniversia@universia.net (hereinafter “Banco Santander”), carries out in virtue of the provision of such services to internet users (hereinafter in the singular “USER” and in the plural “USERS”) through the website http://www.universiasalamanca2018.com (hereinafter, the PORTAL).

The provision of the services will be subject at all times to acceptance of the PORTAL's Legal Notice, these Terms and Conditions and Privacy Policy, and the Cookies Policy.
Banco Santander reserves the right at any time, without prior notice or right to compensation, to deny access to the services offered through the PORTAL to those USERS who do not comply with these General Terms and Conditions and Privacy Policy, the Legal Notice and the Cookies Policy. If Banco Santander has any reasonable grounds to believe that there has been any infringement of these General Terms and Conditions, it will be entitled to delete the Profile of the USER concerned.

The services provided through the PORTAL are the following:

1. To provide information on the 4th Rectors' Meeting – Universia 2018 to be held in Salamanca (Spain) on 21 and 22 May 2018 (hereinafter, "the Meeting").
2. To act as a virtual forum to hold online debates with the participation of all those USERS that, once they have registered using the form provided for this purpose on the PORTAL, wish to do so.
3. To permit those registered USERS who want to attend the Meeting in person to enrol to do so.
4. To permit registered USERS who have enrolled to attend the Meeting in person to develop Networking with the other Meeting attendees using certain instruments provided by the PORTAL and the App.

All the services are free and USERS may deregister at any time by contacting Banco Santander at the addresses given in the "Privacy Policy" section.
To be able to register on the PORTAL, participate in the debates, enrol to attend the event in person and to use the networking services you must be of legal age. In this regard, the USER confirms and guarantees that they are over 18 years of age.

2. TERMS AND CONDITIONS OF USE OF THE SERVICES

2.1. Terms and conditions of the information provision service

The use of the information provision service for the 4th Rectors' Meeting – Universia 2018 is free, voluntary and does not imply the need to register on the PORTAL or to meet any other requirement.
Any USER wishing to access the information contained on the PORTAL may do so, providing they respect at all times the contents of this document itself and its Legal Notice.

2.2. Terms and conditions of participation in online debates service

a) Participation requirements
It is a necessary prerequisite to register on the PORTAL to be able to participate in the online debates that take place through it.
To do this you must complete the registration form provided for this purpose and which includes the personal data of:
⦁ First name
⦁ Surname(s)
⦁ University
⦁ Position
⦁ Country

b) Implications of participation
This participation implies that:
⦁ The details of the USER's first name and surname(s) will be visible to the other participants.
⦁ The participant's comments in the debate will be visible to the other participants.
⦁ The participant USER will receive email and push notifications (if they have downloaded the Meeting App and have registered for the service) related to the development of the debates.

c) Terms and conditions applicable to the inclusion of comments in the debates.
In relation to the inclusion of comments in debates, the USER is prohibited from entering comments which may be offensive, defamatory, damaging or slanderous for third parties, contrary to morality, public order or human dignity, or which may in any other way be illicit or illegal or cause damage or loss to third parties.

Banco Santander reserves the right to immediately and without prior notice, withdraw any comments from debates that they deem to breach the provisions of the previous paragraph.

2.3. Terms and conditions of the enrolment service for attendance of the Meeting in person
Those USERS that have registered on the PORTAL and are going to attend the Meeting in person may enrol to do so using the form provided for this purpose in their private profile area of the PORTAL.
a) Personal enrolment
To do this the USER must provide the following personal data: first name, surname(s), email, telephone, country, nationality and national ID document or passport.
If they have been invited to attend the Meeting by Banco Santander, which covers the associated accommodation and subsistence expenses for the days the Meeting is held, in addition to providing their personal data, as referred to above, the USER must also indicate whether or not they require accommodation and give the dates of their flights, the dates they will be staying in the city and the number of their credit card to enable Banco Santander to arrange their accommodation in the city of Salamanca during the Meeting.
USERS are informed that, in this respect, their personal and credit card details will be given to their chosen hotel only to make the room reservation in their name. No charge whatsoever will be made to their credit card for accommodation or breakfast, however, if the USER decides to use any other service offered by the hotel they will have to be pay for it themselves and it could be charged to this card.
The USER will be notified of the details of the hotel chosen for them nearer to the time of the Meeting.

b) Enrolment of personal companion and academic companion
Those registered USERS who are going to attend the Meeting in person and will be accompanied by other people, that is personal companions and academic companions (hereinafter "third parties"), may enrol them using the respective forms provided for this purpose in their private profile area of the PORTAL.
Banco Santander will not cover the accommodation or subsistence expenses of third parties although, if the USER wishes, Banco Santander will arrange the third parties' hotel reservations for the days the Meeting is held. In this case, the USER will need to give the dates of arrival in Salamanca (the days they are travelling to Salamanca and the time of arrival and departure), those they will be staying in the city and the number of their credit card. In order to arrange the reservations, Banco Santander will notify the corresponding hotel of the third party's details. The number of the credit card is a mandatory requirement for making the reservation.
No charge whatsoever will be made to the card by either Banco Santander or the hotel prior to the third party's stay at the hotel. Only at the end of their stay at the hotel will they be charged for their room and breakfast, and in addition the cost of any services that the third party has availed themselves of while staying there.
In relation to both these and the personal data of third parties included in the form, the USER guarantees Banco Santander that they have obtained the relevant authorisation of the owners of the data to disclose them and that they are solely responsible for their disclosure, with Banco Santander assuming no liability whatsoever for this disclosure, notwithstanding the commitments included in the following paragraph.
Additionally, you:
(i) guarantee to Banco Santander that you have the authorisation and consent of the owner of the personal data provided to enrol them in the Meeting, being responsible for the damages, losses or penalties that may occur in case of breach, falsification or inaccuracy of this guarantee; and
(ii) you are informed that Banco Santander, as recipient of the personal data, assumes the following commitments and guarantees:
1. Personal data will only be used to process the Meeting enrolment application.
2. Banco Santander will not apply the personal data to or use it for any purpose other than this.
3. No personal data will be communicated to any other person, not even for storage purposes.
4. Banco Santander will store the personal data, duly blocked, as long as it may have liabilities relating to them resulting from their processing;
5. In accordance with the terms established by the LOPD (Spanish Data Protection Act), and its implementing regulations, including the Regulation on Security Measures approved by Royal Decree 994/1999, of 11 June, Banco Santander will apply the necessary technical and organisational measures to ensure the security of the management of data and to avoid any alteration, loss or unauthorised processing or access to it.
6. Banco Santander undertakes to maintain the strictest secrecy and confidentiality in the management of data, adopting the measures necessary to prevent its disclosure. This obligation will continue indefinitely both before and after this service has been provided.

2.4. Terms and conditions of the service of Networking between USERS

a) Purpose of the service.
The purpose of this free service is to enable those USERS who are going to attend the Meeting in person to network, if they so wish. In other words, through the use of the technology tools made available to them, the PORTAL and the Meeting App, attendees can develop personal, business and academic relationships within the framework of the Meeting.

b) Requirements for using the service
As we have already indicated throughout this document, the necessary prerequisites to use this service are to be registered on the PORTAL and to be enrolled to attend the Meeting in person.
In addition to the above requirements, an interested USER must also expressly authorise Banco Santander to make their profile visible in the Meeting Directory (hereinafter, "the Directory") by voluntarily checking a box provided for this purpose on the enrolment form. The data that will be visible in this respect are:
⦁ First name
⦁ Surname(s)
⦁ University
⦁ Position
⦁ Country

c) Functioning of the service

c.1 Functioning of the service through the PORTAL
Once the USER has enrolled to attend the Meeting in person and has expressly authorised for their profile to be visible in the Directory, they can, through the Networking area in their personal profile on the Portal, request and, if appropriate, arrange an appointment or meeting with one or more USERS of the service. In addition, it will be possible to book a room at the Meeting venue where this appointment or meeting can be held.

⦁ Request and arrange an appointment or meeting: through the "Networking" (My appointments) tab situated in the USER's private access area on the PORTAL, the USER can track their appointments, request new appointments and directly access their personalised schedule.
⦁ Personalised schedule: through the "Personalised schedule" tab situated in the USER's private access area on the PORTAL, the USER can access their personalised schedule.

c.2 Functioning of the service through the Meeting App
Those USERS who have downloaded the Meeting App and meet the requirements listed in section b) above, will be able to access the Networking services through it. In addition to arranging appointments and meetings, adding them to their schedule and, where required, booking rooms, this app will also allow them to contact another enrolled USER through a chat or instant-messaging service.
This will enable USERS to communicate with other attendees that also have the chat service enabled, with their first name and surname(s) being visible to each other. In addition the service will allow for the possibility of searching for other USERS in the directory through the inclusion of data such as first name and surname(s), the university they represent and the country they are from.

3. USER LIABILITY
The USER will be solely responsible for the use of any services provided and for complying with these Terms and Conditions in their entirety. Consequently, the USER is obliged to keep secret their passcodes, passwords or similar details assigned to them to access the PORTAL or any of the services. They are liable for any damages or losses of any kind derived from improper use by themselves or third parties, including those suffered by the USER themselves, with the damages incurred as a result of their negligence being considered to be those which Banco Santander might incur as a consequence of the failure to comply with these Terms and Conditions.

4. SPECIFIC CONDITIONS OF USE OF THE MEETING APP
The download, access and use by USERS of the Meeting App will be governed by the provisions contained in these Terms and Conditions and in the PORTAL's Legal Notice in every regard to which it may be applicable. In particular, the following sections will be applicable:
1. The conditions of use of the services will be governed by the provisions contained in section “2.- Conditions of use of the services” of the Terms and Conditions.
2. USER liability will be governed by the provisions contained in section “3.- USER liability” of these Terms and Conditions.
3. In matters relating to guarantees and responsibility, section “5.- Warranty and Liability Disclaimer” of the Legal Notice will be applied.
4. The provisions contained in section “6.- Intellectual and Industrial Property Rights” of the Legal Notice will be applicable to everything relating to the Intellectual and Industrial Property Rights of the APPS.
5. In connection with applicable legislation and jurisdiction, the provisions contained in section of these Terms and Conditions will apply.

5. PRIVACY POLICY

5.1. Purpose
The purpose of this privacy policy is to inform the USER of the processing undertaken by Banco Santander S.A., as the data controller, of the personal data they provide when they register on the PORTAL and to use the services it offers.
5.2. Identity of the Data Controller

5.4. Inclusion of your data in a file registered with AEPD
Your personal data we process will be included in a file titled Banco Santander and duly registered with the Spanish Data Protection Agency (AEPD).
5.5. Purpose of processing
a. Description of the purposes of processing
a.1. Processing of personal data provided during registration on the PORTAL
We process your personal data of first name, surname(s), email, country, university and position, which we collect from the PORTAL registration form, in order to manage your access to and participation in the online debates held via the PORTAL.
a.2. Processing of personal data provided during the enrolment process for attendance of the Meeting in person
We process your personal data of first name, surname(s), email, telephone, country, nationality, ID/Passport number and, if appropriate, credit card details, which we collect from the PORTAL enrolment form for attendance of the Meeting in person, in order to manage your attendance and, where relevant, that of your companions, at the event.
In those cases where Banco Santander is to pay their accommodation and subsistence expenses, the data collected will be used to manage their hotel booking and stay. For this reason we have to notify the hotel where you are going to stay of your personal data in relation to first name, surname(s), telephone and credit card. This notification is required to comply with the hotel reservation service provided to you by Banco Santander, as it is indispensable to be able to book a hotel room in your name.
With respect to the data of third parties supplied by the USER, the stipulations established with respect to the provision of personal data by the USER included in section 2.3b of these Terms and Conditions are incorporated by reference and are fully applicable.
a.3. Processing of personal data needed to use the Networking service
As long as you have given us your express permission by checking the corresponding box provided for this purpose on the enrolment form for attendance of the Meeting in person, we will process your personal data of first name, surname(s), country and nationality to enable you to use the networking services, which are defined and explained in section 2.4 of these Terms and Conditions.
The processing of these personal data is necessary in order to provide the networking services which requires these data being visible in the Meeting Directory.
b. Data conservation timelines or criteria
The personal data supplied will be kept for as long as necessary to provide the services, which is until the end of the Meeting.
5.6. Legitimation of data processing
a. Legitimation by USER consent
The legitimation of processing resulting from the USER's registration on the PORTAL to participate in the debates, to attend the Meeting in person and to use the networking tool, is the consent they themselves give by checking the corresponding boxes accepting this document and the visibility of their data in the Meeting Directory.
5.7. Recipients/notification of personal data of third parties
If you have enrolled to attend the Meeting in person and your accommodation and subsistence expenses as covered in section 2.3a) of this document, are going to be covered by Banco Santander, we will have to notify the hotel where you are going to stay of your personal details and those of your credit card in order to make the reservation in your name.
This notification to the hotel is vital for us to be able to process the booking as part of the service we offer you.
In any case, when you provide us with your personal details for the purpose of using this service, you are authorising us to notify the hotel where we are reserving your accommodation of them.
With respect to the data of the third parties that may be accompanying you, where they have opted to delegate the booking of their accommodation to Banco Santander, then they accept that the hotel is notified of their data. In this sense, the stipulations established with respect to the provision of personal data by the USER included in section 2.3b of these Terms and Conditions are deemed to be incorporated by reference and fully applicable by the USER.
5.8. Rights of data subjects
a. Reference to the exercise of rights
You have the right to access your personal data at all times, and to request the rectification of any inaccurate data, or request they be erased when, among other reasons, the data are no longer necessary for the purposes for which they were gathered. In certain circumstances and for reasons relating to your own specific situation, you may object to your data being processed. In such cases, the Foundation will stop processing data, except for compelling legitimate reasons, or the exercise or defence of potential claims.
b. How to exercise your rights of access, rectification, erasure, and the restriction or opposition to processing
To exercise your rights, you can contact Banco Santander S.A., either at the postal address set up for these purposes of Avda. de Cantabria s/n, Edificio Pereda 28660 Boadilla del Monte (Madrid), and/or at the following e-mail address: organizacionivencuentrorectoresuniversia@universia.net.
When doing this, please also send us a photocopy of your National ID card or passport as proof of your identity.
c. Right to withdraw the consent granted
You have the right to withdraw your consent at any time by writing to the addresses above.
d. Right to submit a claim to the Supervisory Authority
You have the right to submit claims to the Spanish Data Protection Agency (Agencia Española de Protección de Datos), based at calle Jorge Juan 6, 28001, Madrid.
5.9. Origin of data
a. Detailed information about the origin of the data and the categories of data processed
The data processed provided by the data subject are not of a sensitive nature and can be included in the following categories:

⦁ Surname(s)
⦁ Email
⦁ Telephone
⦁ Nationality
⦁ Country
⦁ Credit card details (where appropriate)

6. MODIFICATION OF THESE TERMS AND CONDITIONS

Banco Santander reserves the right, at any time and without prior notice, to modify or remove content, structure, design, services and the Terms and Conditions of access and/or use of the PORTAL, whenever it sees fit to do so, and the right to interpret these Terms and Conditions for all matters which may involve their application.

7. APPLICABLE LEGISLATION AND JURISDICTION

These Terms and Conditions will be governed by Spanish law. For all matters which may arise or actions which may be carried out and which result from Banco Santander's management of the PORTAL, and regarding the interpretation, application, compliance or breach of that which is established herein, and the USER, by expressly waiving any other jurisdiction which may correspond to them, the parties submit to the jurisdiction of the Courts and Tribunals of the city of Madrid.
